Important information on Special Condition Entitlements

EU rules dictate that Special Condition Entitlements which are transferred after 3 April 2012 will be converted into Standard Entitlements.

Only Special Condition Entitlements transferred via inheritance can remain under ‘Special Condition’.

Farmers who are transferring in Special Condition Entitlements after 3 April 2012 are required to have the corresponding number of eligible hectares of land to allow the Entitlements to be activated (paid upon), in line with Standard Entitlement activation rules.

If farmers transfer in Special Condition Entitlements without the equivalent number of eligible hectares they will not be able to activate all of them.

Entitlements are subject to a two year usage rule. Entitlements which are not activated within a two year period will be clawed back to the National Reserve.
